Peakime Adaptation & Option Rights Framework

How Peakime handles turning a work into a FANOA production, anime, film or other adaptation — no automatic option, no pre-set price, ancillary rights stay with the creator by default.

Effective 11 August 2026 Last updated 11 August 2026 PeakCraft Studios Private Limited

This Framework doesn’t itself grant PeakCraft any adaptation rights — it explains the process and principles any actual adaptation agreement follows, so a creator knows what to expect before one is ever offered. The specific deal for a specific work always lives in its own separately signed agreement.

We’re publishing this because vague "option" clauses — buried in general publishing contracts, letting a platform acquire a creator’s biggest opportunity at a price set years earlier — are one of the most consistent sources of creator disputes in this industry. Peakime’s approach is built to avoid that.

No adaptation rights from ordinary publishing

Publishing a novel, webtoon or Panel never includes anime, film or game rights — full stop.

First negotiation, never automatic acquisition

A first-look right means Peakime talks first — it never means Peakime can set the price or compel a sale.

Creator gets the majority of the rights fee

Consistent with industry practice for optioned adaptations, separate from the ordinary 60/40 platform split.

Merchandising stays with the creator

Ancillary rights are reserved by default and require their own explicit licence.

What Ordinary Publishing Includes

1. Ordinary Publication Never Includes Adaptation Rights

Publishing a novel on Peakovels, a webtoon on Peakart, artwork on Peakbrush, a Panel on Peakit, or a generated image, video or character on CraftyPeak AI or PeakAI Studio — on its own — never grants PeakCraft the right to adapt that work into anime, film, television, a game or another production. The licence in the Creator & Publishing Agreement is limited to operating the platform: hosting, displaying, streaming and distributing your work as published. Adaptation rights are never bundled into that licence.

If you have not signed a Featured Creator Programme Agreement or a specific adaptation agreement for a work, PeakCraft has no adaptation rights in that work, full stop.

2. Right of First Negotiation, Not an Automatic Option

Where Peakime has a right of first negotiation for a work — because you agreed to one in a Featured Creator Programme Agreement, or because you are separately offering one — that right means Peakime gets the first opportunity to discuss and negotiate an adaptation deal before you offer the work to another studio or platform.

A right of first negotiation has a defined time window stated in the agreement that creates it. If Peakime and the creator don’t reach a signed adaptation agreement within that window, the right lapses and the creator is free to negotiate with anyone — including returning to Peakime later on different terms if both sides want to.
chevron_right It does not mean Peakime automatically owns or can acquire the adaptation rights.
chevron_right It does not mean Peakime can set the purchase price or royalty terms unilaterally.
chevron_right It does not mean you are required to accept whatever Peakime proposes.
How a Real Deal Gets Made

3. How an Actual Adaptation Deal Gets Made

When Peakime and a creator agree to move forward with an adaptation — most often through FANOA, occasionally through direct PeakCraft production interest — the terms are documented in a separate, individually signed production or licensing agreement. That agreement, not this Framework, is the binding document for that specific production, and is expected to address at least the following.

The 60/40 Creator Earnings split applies to ordinary platform consumption — it does not by itself set the compensation for a separately negotiated adaptation deal. Peakime will not represent a term sheet, a verbal conversation or an internal evaluation as a binding adaptation agreement. Only a signed agreement creates binding adaptation rights.
chevron_right Rights being granted — precisely which rights are licensed (e.g. one animated adaptation), not an open-ended grant of "all adaptation rights in all media."
chevron_right Territory and duration — where the adaptation may be distributed and for how long, rather than a perpetual worldwide grant by default.
chevron_right Creator compensation — consistent with industry practice, the creator is expected to receive the majority share of the rights fee attributable to that specific deal, plus any revenue-participation terms the agreement sets out.
chevron_right Credit — how the original creator is credited in the resulting production.
chevron_right Approvals — what creative decisions, if any, require the creator’s sign-off during production.
chevron_right Ownership of newly created production materials — storyboards, character designs, animation cels and scripts made specifically for the adaptation, addressed explicitly rather than left ambiguous.

4. Merchandising and Ancillary Rights Stay With the Creator

Merchandising, video-game rights, tabletop or print-publishing rights, theme-park or experiential rights, and other ancillary rights beyond the specific adaptation being negotiated are reserved to the creator by default. PeakCraft does not acquire these merely by publishing a work, entering a Featured Creator Programme Agreement, or negotiating an adaptation deal — each ancillary category requires its own explicit licence if PeakCraft is to represent or exploit it.

Where PeakCraft’s involvement genuinely benefits from centralising ancillary rights — for example, coordinating merchandising for a successful FANOA production — PeakCraft may offer a separate merchandising representation agreement, disclosing its own royalty terms and duration and requiring its own explicit acceptance. It is never a default consequence of any other Peakime agreement.

FANOA & Your Right to Say No

5. FANOA Productions Specifically

Where an adaptation is being funded in whole or in part through FANOA, the FANOA policy’s revenue-sharing, fan-funding and free-to-watch provisions govern how the production is funded and distributed. This Framework governs the separate question of what rights PeakCraft and the creator are each granting and retaining in connection with that production. Both apply together; neither replaces the other.

6. No Obligation to Sell

Nothing in this Framework, the Creator & Publishing Agreement, or a Featured Creator Programme Agreement obligates a creator to ever accept an adaptation deal. A right of first negotiation is a right to talk first — not a right to compel a sale. If a creator and Peakime cannot agree on terms, the creator remains free to decline, subject only to any first-negotiation window that has not yet expired.

Your Biggest Opportunity, on Your Terms

An adaptation deal should be the best thing that happens to a creator’s career — not a clause they signed away years earlier without realising it. This Framework exists so that when that opportunity comes, it’s negotiated fresh, on real terms, in the open.
