Peakime Creator & Publishing Agreement
The binding contract every creator accepts by publishing on Peakime — what you promise us, what we promise you, and who is responsible if something goes wrong.
This Creator & Publishing Agreement is a binding contract between you and PeakCraft Studios Private Limited. It applies automatically the moment you publish Creator Content or enter a Peakime creator programme — you don’t need to sign a separate document. It supplements the Terms of Service; where the two conflict on a matter this Agreement specifically governs, this Agreement controls that matter.
Non-exclusive by default
Publishing on Peakime never locks your work here — exclusivity only applies if you separately opt in.
You keep your copyright
The licence you grant Peakime is limited to running the platform, not owning your work.
You warrant what you publish
You confirm it’s yours, original, and lawful — and stand behind that if a claim arises.
Indemnification runs to you
If your content gets Peakime sued, you — not Peakime — are financially responsible for that claim.
1. Who This Agreement Covers
This Agreement applies to any person or entity that publishes Creator Content on Peakime, whether or not that content is currently monetised — individual creators, collaborating co-creators, and organisations or studios publishing under a Peakime account are all equally covered.
Where a work has more than one contributor — a writer and an illustrator, for example — each contributing creator is independently bound by this Agreement with respect to their own contribution, and each is independently responsible for having the rights necessary to publish their part of the work.
2. The Licence You Grant Peakime
By publishing Creator Content, you grant PeakCraft a non-exclusive, worldwide, royalty-free licence to host, store, technically reproduce, encode, transcode, resize, format, display, stream, transmit, distribute, index, recommend and otherwise technically process that content to operate, secure and promote the Peakime Services, as more fully described in the Terms of Service.
This licence does not transfer copyright, and does not by itself grant PeakCraft rights to produce a film, anime, game, merchandise line or other adaptation of your work — it is limited to what is reasonably necessary to run the platform you chose to publish on.
3. Your Representations and Warranties
By publishing Creator Content or entering a creator programme, you represent and warrant, on an ongoing basis for as long as your content stays published, that the following are true.
4. Creator Indemnification of Peakime
This is one of the most important sections of this Agreement, because it defines who is financially responsible when a third party brings a claim relating to something you published.
You agree to indemnify, defend and hold harmless PeakCraft Studios Private Limited, its officers, directors, employees, contractors and affiliates (the "Peakime Parties") from and against any and all claims, demands, actions, losses, liabilities, damages, judgments, settlements, costs and reasonable legal fees arising out of or relating to:
How This Indemnity Actually Works
Where a claim covered by Section 4 arises, PeakCraft may, at its own discretion and expense, assume exclusive control of the defence and settlement of that claim. If PeakCraft does so, you agree to reasonably cooperate — providing information, documents and assistance reasonably requested — and you agree not to settle any such claim without PeakCraft’s prior written consent where that settlement would affect PeakCraft.
This is not a one-way street: nothing in this Section requires you to indemnify PeakCraft for a claim arising from PeakCraft’s own breach of this Agreement, gross negligence, or wilful misconduct — those matters are addressed in the Platform Liability, Security & Dispute Resolution Policy.
This indemnification obligation survives the termination of your account, the removal of the relevant Creator Content, and the termination of this Agreement, to the extent the underlying claim relates to Creator Content or conduct that occurred while this Agreement applied to you.
5. Exclusivity and Programme-Specific Terms Live in Separate Agreements
Ordinary publication on Peakime never requires exclusivity. You may publish the same work on other platforms, unless and until you separately and expressly sign a different agreement that says otherwise.
This base Agreement deliberately does not contain exclusivity terms, curated-programme terms or adaptation-option terms — those live in their own dedicated agreements so that what you’re agreeing to is always specific, visible and opt-in, never buried in a general clause.
6. Confidentiality
Where Peakime shares non-public information with you as a creator — beta features, unreleased programme terms, creator-dashboard analytics methodology, or other information reasonably understood to be confidential — you agree not to disclose it to third parties without PeakCraft’s consent, except where disclosure is required by law.
This obligation does not apply to information that becomes public through no fault of yours, information you already lawfully knew, or information you must disclose under a valid legal order, provided you give PeakCraft reasonable notice where legally permitted.
7. Term, Withdrawal and Termination
This Agreement applies for as long as you have Creator Content published on Peakime or participate in a Peakime creator programme.
You may stop publishing at any time by unpublishing or removing your Creator Content, or stopping participation in monetisation, through the tools Peakime provides. Withdrawing a work does not retroactively cancel a separate signed production or licensing agreement already in effect for that work, such as an active FANOA production agreement — that agreement is governed by its own terms.
PeakCraft may suspend or terminate your ability to publish or monetise, in whole or in part, where you materially breach this Agreement, the Terms of Service or applicable Peakime policy, consistent with the enforcement provisions of the Terms of Service.
8. General Provisions
Entire agreement: this Creator Agreement, together with the Terms of Service and the other Peakime policies it references, is the entire agreement between you and PeakCraft regarding your activity as a creator, and supersedes prior discussions on that subject, except where a separate signed programme agreement expressly states otherwise for its own subject matter.
Amendment: Peakime may update this Agreement as the platform, creator programmes and applicable law evolve, providing notice consistent with the Terms of Service. Continued publishing or monetisation after an update takes effect constitutes acceptance, except where applicable law requires renewed express consent.
Assignment: you may not assign this Agreement without PeakCraft’s consent. PeakCraft may assign it in connection with a merger, acquisition, reorganisation or transfer of the relevant Peakime business, subject to applicable law.
Severability and waiver: if a provision is held invalid or unenforceable, the remaining provisions continue to apply. PeakCraft’s failure to enforce a provision on one occasion does not waive its right to enforce it later.
Electronic acceptance: publishing Creator Content, clicking to accept a creator programme, or otherwise using creator features constitutes a valid electronic signature and acceptance of this Agreement, to the same extent as a handwritten signature.
Governing law: this Agreement is governed by the laws of India and subject to the dispute-resolution process described in the Platform Liability, Security & Dispute Resolution Policy.

Most creator agreements bury the important part — who’s responsible when something goes wrong — in language nobody reads. This one says it plainly: you own what you make, Peakime hosts it, and if your content is the reason someone sues, that responsibility is yours, clearly stated in advance rather than discovered in a dispute.
