Peakime Platform Liability, Security & Dispute Resolution Policy

Peakime’s legal role as an intermediary, how liability is limited and allocated, what happens when users dispute each other, platform security, and how disputes with Peakime are resolved.

Effective 11 August 2026 Last updated 11 August 2026 PeakCraft Studios Private Limited

This Policy answers a hard but fair question directly: if something goes wrong because of what a user posted, who is responsible — Peakime, or the user? Peakime is a platform, not the author of what users publish. This Policy explains exactly what that means in practice, and supplements the Peakime Terms of Service.

Peakime is an intermediary

We host what users publish — we don’t author it, and we rely on intermediary safe-harbour protection because of that.

User disputes stay between users

Peakime is not a party to, and doesn’t arbitrate, disputes between individual users.

Liability cap, with real carve-outs

Fraud, gross negligence and wilful misconduct are never excluded — a cap can’t swallow everything.

Arbitration before court

Disputes with Peakime go through informal resolution, then binding arbitration in Nellore, Andhra Pradesh.

Intermediary Status & Liability

1. Peakime’s Role as an Intermediary

Peakime provides the infrastructure that lets users publish, read, watch and interact with content created by other users and creators. Peakime does not write, direct or pre-approve the Creator Content that users choose to publish.

We rely on intermediary status. Under Section 79 of India’s Information Technology Act, 2000, and the due-diligence conditions in the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, an intermediary that meets specified conditions is not held legally responsible for third-party content it merely hosts, transmits or makes available. Peakime relies on this protection, and on analogous protections recognised in other jurisdictions where Peakime operates.

Automated technical processing — formatting, transcoding, security scanning, moderation classification and recommendation ranking — operates the Service and does not, by itself, make Peakime the author or publisher of the underlying user content. Because of this, legal responsibility for what a specific user publishes rests with that user, not Peakime, except where Peakime fails to observe an applicable legal obligation such as acting on a valid takedown notice.

chevron_right We inform users of the categories of content they must not host, upload or share.
chevron_right We observe lawful takedown and government or court orders.
chevron_right We provide a Grievance Officer and grievance process.
chevron_right We do not initiate the transmission of user content, select the receiver of a transmission, or modify its substance in the ordinary course of hosting it.

2. Limitation of Liability

gavel Formal legal language

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Peakime does not warrant that the Services will be uninterrupted, secure or error-free, or that content will be accurate or reliable.

To the maximum extent permitted by applicable law, PeakCraft’s aggregate liability arising out of or relating to the Services will not exceed the greater of the amount you paid PeakCraft in the twelve months before the claim, or one hundred U.S. dollars (US $100). PeakCraft will not be liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, revenue, data or goodwill, even if advised of the possibility of such damages.

This limitation does not apply to, and does not exclude or limit PeakCraft’s liability for: fraud or fraudulent misrepresentation; gross negligence or wilful misconduct by PeakCraft; death or personal injury caused by PeakCraft’s negligence; intellectual-property infringement directly caused by PeakCraft’s own platform materials, as opposed to user content; or any other liability that applicable law does not permit to be excluded or limited by contract. Nothing in this Policy removes a statutory consumer right or remedy that applicable law says cannot be excluded.

Indemnification & User Disputes

3. User Indemnification of Peakime

By using the Services, you agree to indemnify, defend and hold harmless PeakCraft Studios Private Limited, its officers, directors, employees, contractors and affiliates from and against any claims, losses, liabilities, damages, judgments, settlements, costs and reasonable legal fees arising out of or relating to your access to or use of the Services, your violation of the Terms of Service or an applicable Peakime policy, your violation of applicable law, or your infringement of a third party’s rights.

Where you are a creator, Section 4 of the Creator & Publishing Agreement provides a more specific indemnification covering your Creator Content — that provision applies in addition to, not instead of, this general Section.

PeakCraft may assume exclusive control of the defence and settlement of a matter covered by this Section, at its own expense, and you agree to cooperate as reasonably requested. This obligation survives termination of your account with respect to conduct that occurred while you used the Services, and does not require you to indemnify PeakCraft for PeakCraft’s own breach, gross negligence or wilful misconduct.

4. Disputes Between Users Are Not Peakime’s Responsibility

Peakime connects millions of readers, creators and fans. Disagreements between users happen — a plagiarism accusation between two creators, a dispute over a private commission, a disagreement about a collaboration, or harassment between individual users.

Peakime is not a party to disputes between users. Where a dispute arises between you and another user, that dispute is between you and that user. Peakime does not act as an arbitrator, mediator or judge of private disputes between users, and is not liable for the outcome of, or any loss arising from, a dispute between users.

Peakime may act on a valid report under the Community Guidelines or Copyright Policy, may preserve or disclose information in response to valid legal process, and may take enforcement action against an account that violates Peakime’s own rules. None of that constitutes Peakime taking a side in, or accepting responsibility for, the underlying dispute between the users involved. Where a dispute requires a binding resolution, the appropriate path is direct resolution between the users, mediation, or a competent court or arbitral body — not a claim against Peakime.

Where users enter a private arrangement with each other, such as a commissioned artwork or a collaboration agreement, that arrangement is a contract between those users. Peakime is not a party to it, does not guarantee its performance, and is not responsible for either party’s failure to honour it, beyond the payment-specific protections described in the Payments Policy.

Resolving Disputes With Us

5. Dispute Resolution and Arbitration

gavel Formal legal language

Before beginning formal proceedings against Peakime, you agree to first contact us through [email protected] or the applicable support or grievance channel, and to give us a reasonable opportunity — at least sixty (60) days — to understand and attempt to resolve the matter informally.

Consistent with the Terms of Service, you must notify Peakime in writing of any claim or dispute, including a billing dispute, within ninety (90) days of the date the claim or dispute arose, or you permanently waive the right to bring that claim.

Where informal resolution does not succeed, disputes relating to the Services that are not resolved informally shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (India), with the seat and venue of arbitration at Nellore, Andhra Pradesh, India, conducted in English, before a sole arbitrator appointed in accordance with that Act. The arbitrator’s award is final and binding, subject to any right of challenge that applicable law does not permit to be excluded.

You and PeakCraft agree that any claim will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective or representative proceeding.

Either party may bring an individual action in small-claims court where that court has jurisdiction and the matter qualifies. Either party may also seek urgent injunctive relief from a competent court to protect intellectual-property rights or platform security, notwithstanding this arbitration agreement, pending the outcome of arbitration.

This Policy and the Terms of Service are governed by the laws of India, specifically Andhra Pradesh, without regard to conflict-of-laws principles, subject to mandatory consumer and statutory protections that cannot be excluded by contract.

Security & Compliance

6. Platform and System Security

Users must not attempt to bypass security controls, reverse-engineer, decompile or disassemble Peakime software, circumvent digital-rights-management or content-protection measures, scrape or systematically extract data beyond what a normal user session would retrieve, interfere with the Service’s normal operation, or attempt unauthorised access to accounts, systems or data belonging to Peakime or other users.

Violating this Section may result in account suspension or termination, and — where the conduct is unlawful — may be reported to competent authorities. Peakime may pursue civil or other lawful remedies for conduct that damages the platform or other users.

7. Responsible Security Disclosure

Peakime welcomes good-faith reports of security vulnerabilities from independent researchers. If you discover a genuine vulnerability affecting Peakime, please report it to [email protected] rather than exploiting it or disclosing it publicly before Peakime has had a reasonable opportunity to address it.

Where a researcher makes a good-faith effort to comply with this Section — reporting privately, not accessing or modifying data beyond what is necessary to demonstrate the vulnerability, not disrupting the Service for other users, and not exploiting the vulnerability for personal gain — Peakime will not pursue legal action against that researcher for the responsible discovery and reporting of that vulnerability. This safe harbour does not extend to conduct that violates applicable law independent of the disclosure itself, such as theft of data, extortion, or unauthorised access unrelated to good-faith testing.

8. Significant Social Media Intermediary Readiness

Indian law imposes additional due-diligence obligations on intermediaries that qualify as a "Significant Social Media Intermediary" — currently, a threshold based on registered user numbers in India. Peakime does not currently meet that threshold for its social and community features.

Should Peakime’s registered user base in India reach the applicable threshold, Peakime will appoint a Chief Compliance Officer responsible for compliance with the Information Technology Act and applicable rules, appoint a Resident Grievance Officer based in India, appoint a Nodal Contact Person for coordination with law-enforcement agencies, and publish periodic compliance reports disclosing the volume and nature of content-moderation actions taken. This Section will be updated with the relevant appointees’ details once those obligations become applicable.

A Platform, Not a Publisher

Peakime hosts what its users create — it doesn’t author it, doesn’t take sides between them, and doesn’t pretend a liability cap can excuse fraud or gross negligence. This Policy is written so that responsibility lands where it actually belongs: with whoever caused it.
